MIAMY BEACH, Florida – Florida Agriculture Commissioner Nicki Fried plans to sue President Joe Biden’s administration to block a federal law that prohibits medical marijuana users from purchasing firearms or keeping licenses for concealed weapons.
The lawsuit focuses on the federal form, which asks whether the buyer of the weapon is an illegal drug user, and mentions that marijuana is illegal under federal law.
The form of the Bureau of Alcohol, Tobacco, Firearms and Explosives shows:
“Warning: The use or possession of marijuana remains illegal under federal law, regardless of whether it has been legalized or decriminalized for medical or recreational purposes in the state where you live.”
If a person who is legally allowed to use marijuana in Florida says “yes,” he is denied the right to buy a firearm.

Obtaining both a concealed weapons permit and a medical marijuana license is not a problem in Florida. Fried said she had both cards.
In 36 other states, Florida’s permission to conceal weapons is appreciated. The lawsuit is aimed at national forms of acquiring firearms.
“This is just one of many areas where patients with medical marijuana face discrimination or access problems because they are prescribed state remedies,” Fried said. “We hope that the federal government will take steps to eliminate this violation of the constitutional rights of patients with medical marijuana, as well as take steps to legalize cannabis in general to end the dire discrepancies between state and federal laws that continue to harm patients by imprisoning tens of thousands of Americans and stifle the growth of the cannabis industry to the detriment of our economy. ”
The lawsuit will affect patients across the country. Thirty-seven states have legalized medical marijuana, and recreational use is legal in 18 states.
“Medical marijuana is legal. Weapons are legal. It’s all about human rights, ”Fried said a statement from NBC News said. “And I don’t care who I have to sue to fight for freedom.”
