BATH BEACH, Brooklyn (WABC) — Prosecutors will not file criminal charges against two New York City police officers killed a man by pointing a BB gun at them.

The state attorney general says the object Brian Astarita was holding appeared to be a semi-automatic handgun.

Filming took place in November 2021.

One of the officers stopped the man for speeding on the Belt Parkway.

Police say Astarita tried to run and gave chase before the suspect turned his gun on officers.
